PSNC has received permission to appeal in its Judicial Review Case against the Secretary of State. On 20th October 2016, the Secretary of State imposed funding cuts and other changes on community pharmacy. PSNC sought Judicial Review of the decision. On 18 May 2017, Mr Justice Collins gave his judgment, finding against PSNC, but criticising the Department of Health’s (DH’s) consultation process, stating that it was unfair, but not so unfair as to be unlawful. DH had failed to disclose its use of a Companies House analysis that it said showed community pharmacies have an operating margin of 15%. In giving permission for PSNC to appeal, Mr Justice Collins stated: ‘While naturally I am not persuaded that I failed in any of the respects alleged … I recognise the real effect of the cuts on pharmacies and the apparent reliance on the 15% and the non-disclosure.’ The appeal is not likely to be heard for several months. Sue Sharpe, PSNC’s CEO, said: “We hope that we will be able to have constructive discussions with DH and NHS England. Ideally we would like those to mean we did not need to pursue an appeal, but PSNC will do what it feels is right to protect pharmacies and the patients they care for”. Mark Burdon, Regional PSNC Rep said: “I’m very disappointed that we were not able to meet the very high threshold needed to prove that the Department’s actions were unlawful and needed review. Of course any legal process costs money, but the sums of money involved, although large, are nothing in comparison with the cuts that we were seeking to prevent. We felt that we needed to challenge the conduct of the Department, in particular its reliance on a 15% operating margin figure for community pharmacy and withholding information from us, in order to do our best to support the interests of contractors." The Think Pharmacy First service has now been running for a few years. The public benefit from the easy access of this important service across Gateshead & South Tyneside. Following visits to a few community pharmacies we have been asked to supply additional support material to both pharmacies, GPs, local community groups and schools.

As in previous years the LPC's are working accross the region to arrange flu training for this next season. We are currently in negotiation with providers across the patch and will advertise the details as soon as we can. We are hoping to get training in place over the summer months so you are ready to start when the vaccine is available. Keep an eye on our news feed for full details and booking forms. Keep an eye on our news feed for full details and booking forms. You can also follow us on mail, twitter and Facebook. The LPC has become aware that NHS email needs to be accessed regularly or it may be locked or even deleted. If you do not log in every month or so, you run the risk of losing access to email. In our region, we are using Pharmoutcomes for the NUMSAS service and as a consequence NHS mail is largely irrelevant - BUT you must have access to NHS mail to provide the service and for QP as it's a gateway criterion. Advice from the LPC is to log in to NHS mail on a monthly basis Use it or lose it!!
Following on from last week's Healthy Living Pharmacy Meeting the following points will help you to achieve HLP status required for the QP.

Due to the closure of the Gateshead Live Well Hub, Contractors in Gateshead will soon notice an increase in the number of referrals from Gateshead Council and also the Queen Elizabeth Hospital. Referrals from Gateshead Council will either come in the form of a phone call or a fax, whereas the Queen Elizabeth Hospital could use either of the above methods or it may contact the pharmacy through PharmOutcomes in the form of a Transfer of Care message.
The LPC is aware many contractors are increasingly facing more & more problems obtaining some medicines (Generic and Branded). These problems with supply are now being exacerbated by the encouraging of branded generic prescribing within the area. The LPC advises contractors to firstly contact the prescriber to inform them of any supply problem & request a prescription change to an alternative product, but in order to also maintain a national update of these problems, we encourage all contractors to complete the PSNC 'Dispensing & Supply reporting forms' available on the PSNC website. There is a form for branded products and generic products. The form doe not take long to fill and the information provided will be invaluable. These forms along with other resources and information can be found here It's that time of the year again and the CPAF questionnaire has opened. The time window for completion runs from 12th June until 9th July. NHSBSA will contact each individual pharmacy to confirm access to their indiviual link to their questionaire. If you haven't been contacted then please ring 01912035050 or email [email protected]. The actual questionnaire comprises a series of 10 short questions that will take about 10minutes to complete. All pharmacies must complete the CPAF questions before 9th July. For your convenience Below is a copy of the letter sent out regarding this from NHS England |
